Terms of Service

These Terms of Service ("Terms") are an agreement between you and Lula Apps ("Lula Apps", "we", "us"), the operator of Whisper. Whisper is an ephemeral, widget-first messaging app for two paired people, where messages are end-to-end encrypted and disappear after they are viewed. By downloading, accessing, or using Whisper, you agree to these Terms. If you do not agree, do not use the app.

1. Acceptance of these terms

By creating an account or using Whisper, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. We may update these Terms from time to time; if we make material changes, we will revise the "Last updated" date above and, where appropriate, provide notice in the app. Your continued use of Whisper after changes take effect means you accept the updated Terms.

2. The service

Whisper is a messaging app for two paired individuals. Once two accounts are paired, you can send text, photos, voice notes, and videos to each other. Messages are end-to-end encrypted on your device and are ephemeral — they are deleted after your pair views them, or after one week, whichever comes first. The widget on your home screen is a primary surface for the app. Whisper depends on your device, your network connection, and Apple's services to function, and we do not guarantee that it will always be available, uninterrupted, or error-free.

3. Eligibility and age

You must be at least 13 years old — or older if your country requires a higher minimum age to use an online service or to consent to the processing of your personal information — to use Whisper. By using the app, you represent that you meet this requirement and that you are able to form a binding contract with us. Whisper is not directed to children under 13, and we do not knowingly allow them to create accounts.

4. Your account

You sign in with Sign in with Apple or an email one-time code. You are responsible for maintaining the security of the device and sign-in method associated with your account, and for all activity that occurs under it. Whisper enforces single-device sessions for security. Please keep your account information accurate and let us know promptly if you believe your account has been compromised.

5. Acceptable use

You agree to use Whisper only for lawful, personal, non-commercial communication with someone you have chosen to pair with. You agree not to:

• use Whisper for any unlawful purpose, or to violate any applicable law or regulation;
• harass, threaten, abuse, defame, stalk, or harm another person;
• send content that is unlawful, or that you do not have the right to send;
• send sexual content involving minors, or any content that exploits or endangers a child;
• transmit malware, attempt to gain unauthorized access to the service, or interfere with, disrupt, or overload our systems;
• reverse engineer, decompile, or attempt to extract source code or cryptographic keys, except to the extent this restriction is prohibited by law;
• use automated means to access the service, or resell, rent, or commercially exploit the service; or
• impersonate any person or misrepresent your affiliation with anyone.

Because your messages are end-to-end encrypted, we cannot see their content and therefore cannot proactively monitor or moderate them. You are solely responsible for what you send and for how you use the app.

6. Your content

You retain all rights to the messages, photos, voice notes, and videos you create and send through Whisper ("your content"). We do not claim ownership of your content. Because your content is end-to-end encrypted, we only ever hold it in encrypted form, and we cannot read, recover, restore, or hand over its plaintext. You grant us the limited technical permission needed to store and transmit the encrypted form of your content solely to deliver it to your pair. You are responsible for ensuring you have the rights to share any content you send, and for keeping your own copies of anything you wish to preserve — once a message is viewed or expires, it is gone.

7. Subscriptions and billing

Whisper may offer optional auto-renewing subscriptions that unlock additional features. The following terms apply to subscriptions:

• Purchase and payment. Subscriptions are sold and billed by Apple through your App Store account. Apple processes your payment; we do not receive or store your payment card or billing details. We use RevenueCat to verify and manage your subscription status.
• Auto-renewal. Your subscription automatically renews at the end of each billing period unless you cancel it at least 24 hours before the period ends. Your App Store account is charged for renewal within 24 hours before the end of the current period, at the price for your plan.
• Managing and cancelling. You can manage or cancel your subscription, and turn off auto-renewal, at any time in your App Store account settings on your device. Cancelling stops future renewals; it does not retroactively refund the current period.
• Refunds. Purchases are processed by Apple, and refunds are handled by Apple under the App Store terms and Apple's refund policy. We generally cannot grant refunds directly.
• Price changes. If we change subscription prices, the change will apply to future billing periods, and Apple will seek your consent where required before charging a new price.

8. End-to-end encryption disclaimer

Whisper encrypts your message content end-to-end. The private keys are generated on your device and never leave it, which means we have no ability to access, read, decrypt, moderate, recover, or reset the content of your messages. If you lose access to your device or delete your account, your encrypted content cannot be restored by us. End-to-end encryption protects the content of your messages, but no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Disclaimers of warranties

Whisper is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, that messages will always be delivered, or that any defects will be corrected.

10. Limitation of liability

To the fullest extent permitted by law, in no event will Lula Apps or its owners, employees, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, messages, profits, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) Whisper. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or twenty-five U.S. dollars (US$25). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination and account deletion

You may stop using Whisper at any time. You can unpair from another person in the app, and you can delete your account and its associated data from Settings inside the app. When you delete your account, we delete your profile and associated data as described in our Privacy Policy.

We may suspend or terminate your access to Whisper if you violate these Terms, if required by law, or if necessary to protect the service or other users. The sections of these Terms that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and governing law — will continue to apply.

12. Apple App Store terms

Whisper is licensed, not sold, to you for use only under Apple's Licensed Application End User License Agreement, except to the extent these Terms expand on it. You acknowledge that these Terms are between you and Lula Apps, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You agree to comply with all applicable third-party terms (such as your wireless carrier's terms) when using the app.

13. Governing law

These Terms are governed by and construed in accordance with the laws of [jurisdiction to be specified], without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, except where prohibited by applicable law. Nothing in these Terms limits any consumer-protection rights you may have that cannot be waived under the law of your country of residence.
